Terms of use and sale

Who you deal with

Kwern is sold by Alexandre Joly, entrepreneur individuel (sole trader) trading as Kwern, SIREN 912 000 403. The address and phone number are on the legal notice; the email is hello@kwern.app. These terms cover using Kwern and buying it, from anyone: a consumer or a business.

What this covers

Kwern is a subscription to a workspace that drafts marketing work for a product you own and waits for your approval before anything is published or spent. Using it means accepting what is on this page.

Your account

One person owns an account and the products under it. You are responsible for what happens on it, and for keeping the sign-in to yourself.

You approve, so you publish

Everything Kwern produces is a draft until you approve it. Approving a post, a reply, a listing change or a bid is your decision and your publication: you are responsible for what it says, for the rules of the platform it goes to, and for the money an approved bid spends.

Your keys, your accounts

The model runs on your own provider key, billed to you by that provider under their terms. The services you connect stay your accounts, under theirs. Kwern is not a party to either.

What belongs to whom

What you write and what Kwern writes for your product is yours. The open skills it runs keep the licences of the suites they came from, and each one names its source.

No promises about the output

A model writes the drafts, so they can be wrong. Kwern gives no guarantee that a draft is accurate, that a channel will accept it, or that any of it will sell anything. Read before you approve.

Plans and usage

Kwern is sold as plans, Lite, Pro and Max, each billed monthly or yearly. A plan sets how many products you can run and the usage it includes each month. The usage pays for the reads Kwern makes on its own accounts, such as a search, a keyword read or a post read, each at the fixed price in dollars listed on the pricing page. A model turn never counts against your usage: it runs on your own key.

A plan's usage starts again each month, on the day the plan is paid. What is left at the end of the month does not carry over.

A top-up is an amount in dollars bought once, on top of a plan, from $10. It is spent after the plan's usage of the month, at the same prices, and it never expires.

Prices and payment

Prices are on the pricing page and shown again at checkout before you pay. They are shown excluding VAT; checkout adds the tax due, if any, before you confirm. Payment goes through Stripe, in advance: when you subscribe, at each renewal, and when you buy a top-up.

Renewal

A plan renews automatically at the end of each month or year, and the card on file is charged on the day it renews. It goes on renewing until you cancel.

Moving to a higher plan takes effect at once, and the difference for the rest of the period is added to the next invoice. Moving to a lower plan takes effect at the next renewal.

Cancelling

You can cancel at any time from Settings › Billing. The plan keeps running until the end of the period you already paid for, then stops and does not renew. The current period is not refunded, in whole or in part.

Top-ups are not refunded, including when you delete your account. Deleting your account ends your access at once and your plan does not renew; neither the period in progress nor the top-up left is refunded.

These two rules do not limit the withdrawal right below.

Your 14-day withdrawal right

If you buy as a consumer, you have the right to withdraw from the contract within 14 days, without giving any reason (French Consumer Code, articles L221-18 and following). The 14 days run from the day the contract is concluded: the day you subscribe to a plan, or the day you buy a top-up.

To withdraw, tell us of your decision before the 14 days end with a clear statement, for example an email to hello@kwern.app. You may use the model form below, but you do not have to. It is enough to send it before the period ends.

If you withdraw, we refund every payment received from you under that contract, without undue delay and within 14 days of the day we are told of your decision. The refund goes back to the means of payment you used, at no cost to you.

If you buy for your business, this right does not apply.

Model withdrawal form (fill it in and send it only if you want to withdraw):

To Alexandre Joly EI (Kwern), 100 rue Beaupré, Appt 17, 74160 Beaumont, France, hello@kwern.app:

I hereby give notice that I withdraw from my contract for the following service: [the plan or the top-up].

Ordered on: [date]. Name: [your name]. Email of the account: [email]. Date: [date].

Ending it

Deleting your account deletes what is held for it, except the invoices and billing records the law requires us to keep (see the privacy policy). We can close an account that is used to break a platform's rules or the law.

Law and disputes

These terms are governed by French law. If you buy as a consumer, you keep the protection of the mandatory rules of the country where you live, and you can bring a dispute before the courts where you live. Write to us first: most things are solved faster by email.

Changes and contact

These terms can change; the date at the top says when they last did. Questions go to hello@kwern.app.

Someone is asking for what you built today.

On Reddit, on X, in ChatGPT's answers. Kwern finds them every morning and drafts the reply in your voice; you decide what goes out.
